Who Can Apply?

Individuals in any of the following situations:

Parent, mother, or legal guardian of a minor national of another EU/EEA member state or Switzerland, provided that :

  • They reside in Spanish territory.
  • They are responsible for the child.
  • They live with the child or comply with parental responsibilities.

A person providing support to a person with a disability who is a national of an EU/EEA country or Switzerland, provided that :

  • They are a relative of the person with a disability.
  • They are responsible for them.
  • They live together in Spain.

Requirements

You must be physically present in Spain (not applying for international protection).

Continuous residence of 2 years.

You must have no criminal record and pose no threat to public security.

You must not be subject to a return ban or deemed inadmissible to Spain.

FAQs

The Regulation establishes that this provision may only apply to a single family member, provided they meet the requirements.

Authorizations for accompanied minors, whether born in Spain or abroad, have their own specific procedure. Therefore, in these cases, the family root (arraigo familiar) procedure does not apply, and those specific authorizations must be used.

Exceptionally, if the application was not submitted within 6 months of the child’s birth, or from the moment one of the parents obtained residence for duly justified reasons, it may be submitted late. In such exceptional cases, guidance may be requested from the General Directorate of Migration Management.
