WHO CAN APPLY FOR RESIDENCY THROUGH FAMILY ROOTS?

The following individuals may apply for this authorization, provided they live with a Spanish citizen:

Spouse over 18 years of age.

Unmarried partner over 18 years of age :

  • Must have a relationship equivalent to marriage, officially registered in a public registry of an EU,
    EEA, or Swiss country. The registration must be valid, without fraud or cancellation
  •  a stable, unregistered relationship that can be duly proven by at least 12 consecutive months of cohabitation, unless the couple has children in common.

Children of the applicant or their registered/stable partner, provided they :

  • Are under 26 years of age, or older if financially dependent or have a disability.
  • Live with or are going to live with a Spanish family member.l.
  • Are not married and do not constitute an independent family unit, unless they can prove total economic dependence.

Direct ascendants (father or mother) of a Spanish citizen or their registered/stable partner, when :

  • -They are financially dependent and lack family support in their country of origin, or there are humanitarian reasons.

Father, mother, or legal guardian of a minor of Spanish nationality, provided that :

  • They are responsible for the minor and live with them or are up to date with their parental obligations.

Second-degree relative who takes care of a Spanish citizen with recognized dependency.

Children of a father or mother who are or were originally Spanish citizens.

Other relatives not included above who can prove they are financially dependent on the Spanish citizen.

The applicant may reside and work in Spain, in any industry, without any additional permits.

Work without losing your residence: :

Even if you start working, you will retain your residence. You may also apply for an independent residence permit later if you choose to.

No labor market check required :

The availability of job offers in Spain does not impact the approval of your permit. Your application is not subject to the national employment situation.

Bring your family :

You will be able to bring your own relatives to live with you in Spain.

REQUIREMENTS

Regarding the Spanish national family member :

  • Full copy of their valid passport or national ID document.
  • If applying on behalf of a spouse or partner, a sworn declaration stating they are not living in Spain with another spouse or partner.

Regarding the foreign family member :

  • Full copy of their valid passport or travel document.
  • Documentation proving the family relationship with the Spanish citizen.
  • Documentation proving they are financially dependent on the Spanish citizen, when applicable.
  • In specific cases, proof of dependency, cohabitation, degree of kinship, and, if applicable, severe health or disability-related reasons.
  • For unregistered stable partners, documents proving the existence and duration of the relationship and, if applicable, the birth certificate of common children.

When the Spanish citizen resides in Spain and the foreign family member is in their country of origin or residence, the Spanish citizen submits the application at the Foreigners Office corresponding to their place of residence.

When both (Spanish citizen and foreign family member) are in Spain, the application may be submitted if the foreign family member is:

  • Spouse.
  • Registered partner or stable partner.
  • Child under 18 years old.
  • Father, mother, or legal guardian of a minor with Spanish nationality.
  • Second-degree relative who takes care of a Spanish citizen with recognized dependency.

In the family member’s country of origin:

When both (Spanish citizen and foreign family member) are outside Spain, the foreign family member submits a visa application at the Spanish Consulate in their country of origin or residence.

When the relatives include :

  • Dependent children over 18 or children with disabilities.
  • Direct ascendants (father or mother) of the Spanish citizen or of their spouse, registered partner, or stable partner.
  • Other relatives who can prove they are financially dependent.

  • Obtaining the residence card: Once the application is approved, you will receive your residence card approximately within one month.
  • Appointment: We will schedule your appointment at the police station on your behalf.
  • Documentation: Bring your passport and a photo for the Foreigner Identity Card (TIE); we will handle the rest.
  • Fingerprinting: You will receive the TIE within 30 to 45 days, certifying your legal residence in Spain.

FAQ

The applicant will obtain the following rights:

  • The right to reside and work in Spain, either as an employee or self-employed, in any sector and location.
  • An initial validity of 5 years (or less if the Spanish national resides for a shorter period).
  • It may be renewed for another 5 years if the conditions are maintained.
  • It allows the foreign family member to also exercise their own right to family reunification.

The immigration office must issue a decision within a maximum period of 2 months from the date the application is submitted.
If no response is received within that period, the application is considered denied due to administrative silence.

The authorization may be lost if:

  • There is no effective family cohabitation.
  • The Spanish citizen or their partner establishes another parallel relationship.

However, the foreign family member may apply for independent residence in cases such as:

  • Death of the Spanish citizen.
  • Divorce, annulment, or cancellation of a registered partnership (if there was cohabitation of at least 3 years, custody of children, or visitation rights).
  • When the foreigner is a victim of gender-based violence, sexual violence, violent crimes within the family environment, or human trafficking.
